Evenfolk — Terms of Service
This document is a draft and is being finalised.
Effective date: to be confirmed
Last updated: to be confirmed
1. Agreement
These Terms are a binding agreement between you and to be confirmed, to be confirmed ("Evenfolk", "we", "us") governing your use of the Evenfolk mobile application and the evenfolk.app website (together, the "Service").
By creating an account or using the Service you accept these Terms. If you do not accept them, do not use the Service.
Our Privacy Policy explains how we handle your personal data and forms part of this agreement.
2. Eligibility
You must be at least 16 years old and legally able to enter into a contract. If you use the Service on behalf of an organisation, you confirm you are authorised to bind it to these Terms.
3. Your account
- Provide accurate information when you sign up and keep it current.
- You are responsible for keeping your password confidential and for everything that happens under your account.
- Tell us at support@evenfolk.app promptly if you suspect unauthorised access.
- One person, one account. Do not share your account or transfer it to someone else.
4. What Evenfolk is — and what it is not
Evenfolk is a record-keeping tool. It is not a payment service.
- We do not hold, transmit, receive, or settle funds. We are not a bank, a payment institution, an e-money issuer, a money transmitter, an escrow agent, or a debt collector, and we are not licensed as any of those.
- Balances, debts, and "who owes whom" figures shown in the app are an informational summary of what you and other members entered. They are not a statement of account, an invoice, or legally binding proof of a debt.
- When you settle up, the Service may open your own banking or wallet app, generate a payment code, or copy payment details to your clipboard. That payment happens entirely between you, the other person, and your own payment providers. We are not a party to it, we do not verify it, and we do not know whether it succeeded.
- Marking a debt as settled in the app changes a record in the app. It does not move money and does not by itself discharge any obligation between you and another person.
- Any legal or financial relationship arising from a shared expense is between you and the other people involved. Disputes about who owes what are yours to resolve; we are not an arbiter and we will not adjudicate them.
- Nothing in the Service is financial, tax, accounting, or legal advice.
5. Your content
You keep ownership of everything you put into the Service — expenses, notes, receipt images, avatars, and so on ("Your Content").
You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and transmit Your Content solely to operate and provide the Service to you and to the people you share it with. This licence ends when you delete the content or your account, subject to the shared-data limits described in the Privacy Policy and in section 6 below.
You confirm that you have the right to upload Your Content and that it does not infringe anyone else's rights.
6. Shared groups
The Service works by sharing. When you join or create a group:
- every member of that group can see the group's expenses, amounts, splits, settlements, and each member's display name and avatar;
- content you add to a shared group becomes part of a shared financial record that other members rely on;
- accordingly, leaving a group or deleting your account does not remove that shared record — your entries are anonymised so other members' balances stay correct. See section 6.1 of the Privacy Policy.
Only add to a group what you are willing for its members to see. Only invite people you trust with that information.
7. Acceptable use
Do not:
- break the law, or use the Service to defraud, harass, threaten, stalk, or extort anyone;
- upload content that is illegal, abusive, hateful, sexually explicit, or infringes someone else's rights;
- upload another person's payment details, identity documents, or personal data without their permission;
- attempt to access accounts, data, or systems that are not yours, or probe, scan, or test the security of the Service without our written permission;
- reverse-engineer, decompile, scrape, or build a competing product from the Service, except where that restriction is void under applicable law;
- overload or interfere with the Service, or use bots or automated means to create accounts or generate traffic;
- resell, sublicense, or commercially redistribute the Service.
We may remove content or suspend accounts that breach this section.
8. Paid plans and in-app items
8.1 Subscriptions
Parts of the Service may require a paid plan. Prices, billing periods, and included features are shown in the app before you buy.
- Purchases are processed by Apple's App Store or Google Play, not by us. Their terms apply to the transaction, and we never receive your card details.
- Subscriptions renew automatically for the same period until you cancel.
- Cancel through your App Store or Google Play account settings — deleting the app does not cancel a subscription.
- Cancellation stops the next renewal; the plan stays active until the end of the period you already paid for.
- Refunds are handled by the store under its own policy. Where the law gives you a statutory right of withdrawal or refund, that right applies regardless of this section.
8.2 Coins and cosmetic items
The Service may include coins and cosmetic items (themes, icons, badges).
- Coins are a limited, personal, non-transferable licence to use a feature inside the Service. They are not money, not a currency, not a stored value or e-money instrument, and not property.
- They have no cash value, cannot be exchanged for money or transferred to another person, and cannot be redeemed outside the Service.
- We may change, limit, or discontinue coins and cosmetic items. Unused coins are forfeited when your account is closed for breach of these Terms. If we discontinue coins entirely, we will give reasonable notice and, where you paid real money for unused coins, a proportionate refund or equivalent benefit where the law requires it.
9. Availability and changes
We aim to keep the Service running, but we provide it on an "as available" basis. We may modify, suspend, or discontinue features, and we may carry out maintenance that makes the Service temporarily unavailable. Where a change materially reduces what you paid for, we will give you notice and, where required, a proportionate refund.
We may update these Terms. If a change is material, we will notify you in the app or by email at least to be confirmed days before it takes effect. Continuing to use the Service after that date means you accept the new Terms; if you do not, you may close your account.
10. Third-party services
The Service links to and hands off to third parties — banking and wallet apps, the App Store and Google Play, and payment links other users publish. We do not control them, do not endorse them, and are not responsible for their content, terms, availability, or for anything that happens after the hand-off. Check the recipient's details before you send money to anyone.
11. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement.
In particular, we do not warrant that the Service will be uninterrupted or error-free, or that calculations, balances, currency conversions, or exchange rates are accurate. Exchange rates are indicative, come from third-party sources, and are not the rate your bank will apply. Check anything that matters financially before you act on it.
Nothing here excludes liability that cannot lawfully be excluded — including for death or personal injury caused by negligence, for fraud, or under mandatory consumer protection law.
12. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, nor for lost profits, lost data, or amounts you paid, failed to collect, or overpaid to another person as a result of using the Service.
Our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, and (b) to be confirmed.
If you are a consumer, this section applies only to the extent permitted by the consumer law of your country of residence, and does not affect your statutory rights.
13. Indemnity
If you are using the Service other than as a consumer, you agree to indemnify us against claims, damages, and reasonable costs arising from your breach of these Terms, your content, or your unlawful use of the Service.
14. Termination
You may stop using the Service and delete your account at any time from Settings.
We may suspend or terminate your access if you materially breach these Terms, if we are required to by law, or if we discontinue the Service. Except where a serious breach or a legal requirement makes it impossible, we will give you reasonable notice and a chance to export your data.
Sections 4, 5 (as to content already shared), 6, 11, 12, 13, and 15 survive termination.
15. Governing law and disputes
These Terms are governed by the laws of to be confirmed, without regard to conflict-of-law rules. Disputes go to the courts of to be confirmed.
If you are a consumer resident in the EEA or the UK, this does not deprive you of the protection of the mandatory laws of your country of residence, and you may bring proceedings in your local courts. EU consumers may also use the European Commission's online dispute resolution platform.
16. General
- If a provision is found unenforceable, the rest stays in force.
- Our failure to enforce a provision is not a waiver of it.
- You may not assign these Terms; we may assign them to a successor in a merger or acquisition.
- These Terms and the Privacy Policy are the entire agreement between us about the Service.
- The English version prevails if a translation conflicts with it.
